All sales are final. Purchases are NON-REFUNDABLE. Subscription cancellations take effect at the end of the current billing period.

1. Definitions
In these Terms of Service, the following definitions apply:
- "Service" — The PeakPedal platform, including the website, web application, APIs, and all related services operated by PeakPedal.
- "User" — Any individual or entity that creates an account and uses the Service.
- "Content" — Any data, text, images, videos, training programs, workouts, or other materials created, uploaded, or stored using the Service.
- "PeakPedal" — The operator of the Service.
2. Our Services
2.1 Service Description
PeakPedal is a fitness and workout tracking platform that enables users to track workouts, manage training plans, and achieve their fitness goals.
2.2 Service Availability
We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability. We will provide reasonable notice for scheduled maintenance when possible.
2.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of significant changes that affect your use of the Service.
3. User Accounts
3.1 Account Registration
To use the Service you must be at least 18 years of age and provide accurate, complete registration information. You are responsible for maintaining the security of your account credentials and for promptly updating your information when it changes.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We may suspend or terminate your account if you violate these Terms of Service, engage in fraudulent or illegal activities, fail to pay subscription fees when due, provide false or misleading information, or pose a security risk to the Service or other users.
4. Subscription & Billing
PeakPedal may offer subscription or paid features in the future. Any subscription and billing terms will be communicated when applicable and will comply with the principles set out in these Terms.
5. License Agreement
5.1 License Grant
Subject to your compliance with these Terms, PeakPedal grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business coaching activities.
5.2 License Restrictions
You may not sublicense, sell, or transfer your access to the Service; reverse engineer, decompile, or disassemble any part of the Service; or use the Service to develop a competing product or service. You may not copy or reproduce any part of the Service without permission, use automated systems (such as bots or scrapers) to access the Service, share account credentials with unauthorized users, or circumvent any security measures or access restrictions.
5.3 Intellectual Property
The Service, including all software, design, text, graphics, and other content, is owned by PeakPedal and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the Content you create using the Service.
6. Acceptable Use
6.1 Prohibited Activities
When using the Service you agree not to violate any applicable laws or regulations, infringe on the rights of others, or upload malicious code or content. You may not harass, abuse, or harm other users, impersonate any person or entity, interfere with the proper operation of the Service, attempt to gain unauthorized access to the Service or other accounts, or use the Service for any illegal purpose.
6.2 Content Standards
All Content you create or upload must not be defamatory, obscene, or offensive; promote illegal activities; infringe on intellectual property rights; contain personal information of others without consent; or contain malware, viruses, or harmful code.
7. Data & Content
7.1 Your Content
You retain ownership of all Content you create using the Service. By using the Service, you grant PeakPedal a limited license to host, store, and display your Content as necessary to provide the Service.
7.2 Data Security
We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge and accept the inherent risks of transmitting data over the internet.
7.3 Data Export
You may export your Content at any time through the Service's export features. Upon account termination, you will have a limited period to export your data before it is deleted.
7.4 Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Limitation of Liability
8.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAKPEDAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.
8.3 Maximum Liability
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
8.4 Professional Advice
The Service is a tool for fitness and does not constitute medical, health, or fitness advice. Users are responsible for ensuring their use of the Service is appropriate for their circumstances. PeakPedal is not responsible for any injuries or health issues that may result from use of the Service.
9. Termination
9.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until that time.
9.2 Termination by Us
We may terminate or suspend your account immediately if you violate these Terms. We may also terminate inactive accounts or accounts without paid subscriptions after a period of inactivity.
9.3 Effect of Termination
Upon termination your license to use the Service immediately ends and you must cease all use. You will have a limited period to export your Content; after that period your Content may be deleted. Provisions that by their nature should survive termination will remain in effect.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 15 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.

12. Governing Law
